Louisiana Bans Intentional Balloon Releases Beginning August 1

Baton Rouge, La. (5/29/2026) —Louisiana residents who intentionally release balloons into the air could soon face penalties under a new state law.

House Bill 851 became Act 196 during the 2026 Regular Session. The measure became law on May 15, 2026, without Governor Jeff Landry’s signature. It takes effect August 1, 2026.

The Louisiana balloon release law expands the state’s littering statutes. It prohibits the intentional release of balloons and organized events that include a planned release of twelve or more balloons.

Violators are subject to the same penalties that apply to intentional littering offenses under Louisiana law.

However, the law includes several exceptions. It does not apply to anyone under 17 years old. It also does not apply to accidental balloon releases or balloons released indoors.

In addition, the law exempts balloons made from biodegradable or photobiodegradable materials. Scientific and weather-related balloon releases conducted by government agencies, contractors, or educational institutions remain legal.

The law also allows balloons attached to radio tracking devices when released by licensed amateur radio operators. Likewise, recovered hot air balloons are exempt.

For enforcement purposes, the intentional release of multiple balloons at a single event, location, or time is considered one violation.

Law enforcement agencies have up to one year to issue a citation after they know, or reasonably should know, about the violation.

Supporters of the measure said it will help reduce litter across Louisiana. Beginning August 1, residents and event organizers will need to ensure balloon releases comply with the new law.
